Medical Malpractice Coverage

Settlement & Judgment Costs

Medical malpractice coverage insures you against claims of negligence or of making a mistake that causes bodily harm to a patient. This includes providing you with a lawyer to defend yourself and the funds you can use to pay judgments or settlements.

Amount Covered: Typical limits of liability range from $500,000 per claim/$1 million aggregate to $1 million per claim/$6 million aggregate.

Defense Counsel

If a claim is filed against you, we’ll retain an experienced malpractice lawyer for you. We’ll pay for related defense costs (e.g., lawyer fees, court fees, expert witness costs). These defense costs are “outside” the limits of your insurance. This means that their services won’t cut into the money available to cover settlements, judgments, and other costs.

Amount Covered: Paid in addition to your policy’s limits

Worldwide Coverage

Your policy applies on a worldwide basis, as long as a claim is brought against you in the United States (which includes any U.S. territories or possessions). That means your coverage will follow you wherever you practice.

Good Samaritan Coverage

If you provide professional care to someone who is not your patient in a first aid or emergency situation, and that person files a claim against you, your policy will still apply.

Consent to Settle

We work with your defense attorney to reach the best possible outcome for you. We won’t settle a claim without your approval.

Automatic Coverage Extensions

HIPAA Violation Defense

If you are investigated for potential HIPAA violations, we’ll provide you with access to counsel and will reimburse you for costs related to HIPAA proceedings — including HIPAA fines.

Amount Covered: $25,000 per policy period

Board Action & License Protection Defense

If the professional licensing authority is investigating matters related to your professional conduct, our policy provides you with legal defense.

Amount Covered: $25,000 limit per policy period

Wage Loss & Deposition Expenses Coverage

If we ask you to attend litigation activities (e.g., a deposition), our policy will reimburse you for actual lost wages and any necessary expenses you incur (e.g., travel, meals).

Amount Covered: Up to $1,000 per day

Reputation Coverage

If you face a threat to your professional reputation, we can provide you with a crisis management/public relations consultant to help clear your name.

Amount Covered: $50,000 per claim

Optional Coverages

Additional A La Carte Coverages (by Endorsement)

Business/General Liability Coverage

The policy applies if a third party files a claim against you alleging that your premises or operations caused them bodily injury or harm.

Amount Covered: $1 million occurrence/$1 million aggregate

Medicare/Medicaid Reimbursement Endorsement

If you’re audited by either Medicare or Medicaid, we can reimburse you for related accountant or attorney costs that result from the investigation or defense of the audit proceedings.

Amount Covered: $30,000 for a covered audit and related expenses

Billing Errors & Omissions

This optional endorsement covers claims concerning errors and omissions in your billing practices.

Amount Covered: $25,000 per claim, subject to a maximum limit payable of $25,000 for all claims.

Medical Director Coverage

This optional endorsement protects you in your role as a medical director, adding coverage for your administrative services in addition to your professional services. It covers potential liabilities arising from your oversight and management duties, rather than direct patient care, such as errors in policies or protocols. This coverage is available only in positions where you have no voting or ownership interest.

Amount Covered: The coverage amount is equal to your policy’s limits of liability. Typical limits of liability range from $500,000 per claim/$1 million aggregate to $2 million per claim/$6 million aggregate.

Nurses’ Frequently Asked Questions

Whether or not a nurse is at fault – or if the claim is spurious – these are some of the most common medical errors that can result in malpractice lawsuits:

  • Adverse drug reactions
  • Burns
  • Equipment failures
  • Failure to provide prophylactic treatment
  • Falls
  • Improper transfusions
  • Misdiagnosis or delay in diagnosis
  • Failure to act on lab results or use the correct tests
  • Mistaken patient identities
  • Pressure ulcers and deep vein thromboses
  • Suicides
  • Restraint-related death
  • Under- and-overtreatment or errors in administering treatment

A malpractice claim not only impacts your finances, but it can also threaten your nursing license, damage your reputation, and consume your valuable time – not to mention the potential emotional toll.

If you ever face a lawsuit, your Berxi coverage will put a dedicated attorney and a team of claims professionals in your corner to help you through the ordeal. And if you’re found liable for damages, settlements, or other fees, Berxi can help cover the costs. Malpractice insurance can be a financial lifesaver for nurses who find themselves facing a malpractice lawsuit.

Even though you may be covered by your employer’s policy, there are a number of situations in which their insurance might not protect you, or might provide inadequate financial coverage. In the event of a malpractice claim, your supplemental malpractice policy can give you the peace of mind that comes with knowing you have the protection you need. Benefits include:

  • Legal defense for licensing board actions, which is often not covered by employer policies.
  • Extra funds, which can be helpful if many members of the team are named in the same suit as you.
  • Personal legal counsel, meaning you are the main point of contact with your defense team.
  • Protection in HIPAA-related claims and actions, usually not covered by your employer.
  • Control over deciding whether to settle. Employer policies might be more likely to force your hand.
  • Reputation coverage, which is usually not provided by employer policies.

While some specialties may have more risk, there is no specialty or area of practice where a nurse has no risk. Most plaintiffs in malpractice suits will name the entire care team involved, so even if you’re not directly involved, you could find yourself facing a lawsuit.

According to data from the National Practitioner Data Bank, the number of medical malpractice payments for nurses has nearly quintupled since the early 1990s, and between 2015 and 2022, the average malpractice payment for an RN was $359,826. With numbers like that, there is more risk than ever in not having medical malpractice insurance.

No. In fact, there’s no way for a patient or anyone else to find out if you have your own insurance. No database or list exists that identifies nurses who have malpractice policies and those who do not.

This means that the patients and any attorneys who represent them cannot access information about whether you have an individual policy. Additionally, unless you tell your employer, it will not know that you have an individual or a supplemental policy.
