Why Do I Need Nursing Malpractice Insurance?

No matter whether you’re an RN, LPN, or LVN, you could get sued. For example, a patient (or their family) could accuse you of acting negligently and, consequently, make a claim or file a lawsuit against you. When this happens, matters need to be sorted out — and this often means that lawyers will be involved. And this will likely cost time and money, in addition to creating a whole lot of stress. Having the dedicated team at Berxi behind you can relieve much of this burden.

You’ve worked hard to get where you are. Medical malpractice insurance helps you take care of yourself while you take care of others.

Do Nurses Really Get Sued?

Unfortunately, yes. Here are some statistics from 2016:

  • The average claim in 2015 was $164,586.
  • Claims show no gender bias.
  • Nurses with additional certifications working in high-risk areas were sued the most: 36% specialized in adult medical/surgical fields; 16% specialized in aging services; and 12% specialized in home health/hospice care.
  • 41% of the medical malpractice suits occurred when the patient’s death was not the expected outcome for the treatment or disease.
  • Nurses who had rapid access to clinical information at their place of employment had lower indemnity payments than those without access to the data.
  • 79% of med mal suits involved nurses who’d been practicing for 11 years or more.
  • $4,000 is the average cost that nurses spent on legal defense.
  • How Much Does Malpractice Insurance Cost for Nurses?

Malpractice insurance policies for RNs start at about $65 a year. However, the cost of your specific quote will depend on a variety of factors, including your years of experience, education, state(s) in which you work, and time spent on the job.**

The best way to get an accurate idea of what your policy would cost is by filling out our quick online application to get a quote. The process takes a minute or two, and — if you choose to purchase — your policy can go into effect any day you’d like, including today.

What Are the Pros and Cons of Nursing Malpractice Insurance?

Well, it does cost money each year. That’s the only con we can think of.

But the pros truly outweigh the con because without insurance, you would have to pay out of pocket for legal fees and settlement costs. With a malpractice policy, you have insurance that protects you by providing you with defense counsel and limits of insurance available for indemnification and settlement.

My Workplace Already Covers Me. Do I Still Need My Own Policy?

You want your own liability insurance because you want to have your own dedicated team whose sole interest is you — not your employer, other medical professionals, or someone else’s bottom line. Even if your employer provides coverage, here are some important things to consider:

  • A fellow employee could submit a claim against you. Your company’s policy may exclude coverage for claims of one employee against another employee.
  • If you’ve changed jobs and a claim is filed against you for actions while you were with your previous employer, your prior company’s policy may no longer cover you.
  • Your employer’s policy may not cover your lost wages that accrue while you attend legal proceedings.
  • If a number of employees are named in the same claim, your employer’s policy may not have adequate limits to protect you and your fellow employees.
  • Having your own policy can help you feel more comfortable if a claim is filed against you. With your own policy, you’ll have access to your own legal representation, and the resources of the policy aren’t shared among multiple insureds.

If I’m a Traveling Nurse, How Do I Get Insurance If I Work in Different States?

On your application, simply select the state in which you primarily practice or do the majority of your work. Your Berxi policy follows you across all 50 states (and Washington D.C.), so work performed outside of the state where you primarily practice will be insured under your policy.**

Do I Need Insurance If I Work for a Nurse Staffing Agency?

It’s a good idea to have your own dedicated malpractice policy, just as if you worked full time at a hospital or clinic. Given the low cost of our RN policies, it’s a small price to pay for peace of mind.

Regardless, you’ll want to confirm if you have medical malpractice coverage through your staffing agency, or if it’s provided by the employer with whom you’re being placed. Then read your policy to make sure that you feel sufficiently covered. If you notice any gaps in coverage or lots of fine print, don’t forget that we’re here and can help you get additional coverage — plus that added peace of mind.

Do You Provide Coverage for Me While I Go Back to Nursing School?

Yes, we do. There are two ways to do this. If you’d like coverage as an RN and as a student, you can simply purchase an RN policy and we can add a student endorsement to it. But if you prefer coverage only as a student, we also offer a variety of student policies that start at about $14 per year.**
